TERMS OF SERVICE

ElationMgmt is operated by Elation Marketing Group LLC, a TikTok Shop and creator management agency. We provide TikTok Shop ready accounts, source products, edit creator content, and negotiate brand deals on behalf of creators we partner with. We also sell social media accounts (TikTok, Instagram, YouTube) through our Purchase Accounts service.

You must be at least 18 years old and legally able to enter into a binding contract to use our services. By submitting an application or purchasing from us, you represent that you meet these requirements and that all information you provide is accurate, current, and complete.

If your application is accepted and you sign on as a creator with ElationMgmt, the following applies in addition to any separate creator agreement you sign with us:

• What we provide: a TikTok Shop ready account, product sourcing, video editing, posting, and deal negotiation.
• What you provide: consistent raw video footage (typically 3 to 5 short videos per week), on camera presence, and timely communication.
• No upfront cost: there is no signup fee. Elation is compensated through a share of creator earnings, brand deals, and TikTok Shop commissions as outlined in your individual creator agreement.
• Account ownership: TikTok Shop accounts we provide as part of a creator partnership remain the property of Elation Marketing Group LLC during the term of the partnership. Account purchases through our Purchase Accounts service are governed by Section 7.

Submitting the signup form does not guarantee acceptance into our roster. We review every application and reach out within 24 to 48 hours to either schedule or confirm your intro call.

When you book a 15 minute intro call, the time you select is added to our calendar. If you choose Google Meet as your preferred contact method, a Meet link is generated and sent to the email address you provided. You are responsible for showing up on time and providing accurate contact details. We may reschedule or cancel calls at our discretion.

You retain ownership of the raw footage and likeness you provide to us. By submitting content to Elation, you grant us a worldwide, royalty free license to edit, modify, post, promote, and distribute that content across TikTok, Instagram, YouTube, and any other channels operated by us or our brand partners for the duration of our partnership and a reasonable archival period after termination.

You represent that your content does not infringe any third party rights, contain unlawful material, or violate the rules of any platform we post to.

Creator payouts are issued on the 15th of each month for the prior calendar month, subject to platform payout timing and any holds, chargebacks, or returns. Payments are made via PayPal, Zelle, Wire, or ACH based on what you provide.

You are responsible for the accuracy of your payout details and for all taxes owed on income you earn through ElationMgmt. We may be required to issue tax forms (such as a 1099 in the United States) based on your earnings.

Accounts sold through our Purchase Accounts service are delivered with login credentials and any documentation we have on file. Once an account is delivered and credentials are transferred:

• Ownership and full responsibility for the account transfers to you.
• All sales are final unless we fail to deliver the account or the account is materially different from what was advertised. Refund requests must be submitted within 48 hours of delivery.
• We do not control the policies of TikTok, Instagram, YouTube, or any third party platform. We are not responsible for suspensions, bans, shadow bans, monetization changes, or algorithm changes that occur after delivery.
• You agree to comply with the terms of service of the underlying platform after the account is transferred to you.

We negotiate brand partnerships, sponsorships, and ambassador deals on behalf of creators in our roster. Any deal we secure is presented to you for approval. You retain the right to decline a deal, but repeated refusal of viable opportunities may affect your standing in the program. Commission splits and exclusivity terms are governed by your individual creator agreement.

You agree not to use ElationMgmt services to engage in fraud, harassment, hate speech, harm to minors, infringement of intellectual property, sale of prohibited goods, or any activity that violates applicable law or the policies of the platforms we post to. We may suspend or terminate your participation immediately for any such conduct.

Either party may terminate the creator partnership in accordance with the notice terms of your individual creator agreement. We may suspend or terminate your access to our services at any time for breach of these Terms, inactivity, or conduct that harms our business or reputation. Upon termination, your right to use any Elation owned account, content, or materials ends immediately.

Any income figures, testimonials, or examples referenced on our site (including statements about $1k to $10k months, total creator payouts, or the number of creators we have helped) are illustrative. They are not a promise, projection, or guarantee of your individual results. Your earnings depend on your effort, consistency, content quality, niche, platform conditions, and factors outside our control.

All ElationMgmt branding, the ElationMgmt name, logos, website design, copy, and underlying code are owned by Elation Marketing Group LLC and protected by intellectual property laws. You may not copy, redistribute, or use our branding without our prior written permission.

Our services depend on third party platforms including TikTok, Instagram, YouTube, Google (Calendar and Meet), Gmail, and payment processors. We are not responsible for the availability, policies, or actions of those platforms. Your use of those platforms is governed by their own terms.

ElationMgmt services and any accounts, content, or deals delivered through them are provided "as is" and "as available" without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, non infringement, or uninterrupted service.

To the maximum extent permitted by law, Elation Marketing Group LLC and its members, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of ElationMgmt. Our total liability for any claim related to the services will not exceed the greater of the amount you paid to us in the six months before the claim or one hundred US dollars.

You agree to defend, indemnify, and hold harmless Elation Marketing Group LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your content, your use of our services, your violation of these Terms, or your violation of any law or third party right.

These Terms are governed by the laws of the United States and the state in which Elation Marketing Group LLC is organized, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or our services will be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. Material changes will be communicated by email to active creators. Your continued use of ElationMgmt after changes become effective constitutes acceptance of the revised Terms.
